Parcourez cet article pour d\u00e9couvrir 5 \u00e9l\u00e9ments essentiels \u00e0 conna\u00eetre, allant du contrat pr\u00e9liminaire jusqu\u2019\u00e0 la signature chez le notaire, avant de plonger dans l\u2019aventure.<\/p>\n<p><strong>1.\u00a0Le contrat pr\u00e9liminaire<\/strong><\/p>\n<p>En ayant l\u2019intention d\u2019habiter le condo sur plan que vous ach\u00e8terez, vous aurez l\u2019obligation d\u2019\u00e9tablir un contrat pr\u00e9liminaire avec le promoteur ou l\u2019entrepreneur responsable du projet. Tr\u00e8s semblable \u00e0 une <a href=\"https:\/\/www.centris.ca\/fr\/blogue\/immobilier\/les-questions-a-se-poser-avant-de-faire-une-offre-d-achat?uc=1\" target=\"_blank\" rel=\"noopener\">offre d\u2019achat<\/a>, celui-ci vous engage \u00e0 acheter le condo sous certaines conditions, tout en vous offrant diverses protections. \u00c0 noter que la signature du contrat pr\u00e9liminaire n\u2019est pas obligatoire si vous achetez le condo dans le but de le louer \u00e0 une tierce partie.<\/p>\n<p><strong>2.\u00a0Les clauses obligatoires<\/strong><\/p>\n<p>R\u00e8gle g\u00e9n\u00e9rale, le contrat pr\u00e9liminaire contient les m\u00eames clauses qu\u2019une offre d\u2019achat, mais comporte certaines obligations suppl\u00e9mentaires.<\/p>\n<p><strong>Droit ou facult\u00e9 de d\u00e9dit<\/strong><\/p>\n<p>Le droit ou la facult\u00e9 de d\u00e9dit repr\u00e9sente un d\u00e9lai durant lequel vous pouvez choisir de ne plus acheter le condo sur plan en vous r\u00e9tractant. Celui-ci doit \u00eatre d\u2019au moins dix jours apr\u00e8s la r\u00e9ception de la note d\u2019information. Si vous utilisez votre droit de d\u00e9dit, la loi permet n\u00e9anmoins au promoteur d\u2019exiger le paiement d\u2019une indemnit\u00e9 ne pouvant exc\u00e9der 0,5 % du prix de vente convenu.<\/p>\n<p><strong>Remboursement de l\u2019acompte<\/strong><\/p>\n<p>Vous aurez probablement \u00e0 verser un acompte au moment de la signature du contrat pr\u00e9liminaire. Si c\u2019est le cas, la loi pr\u00e9voit l\u2019obligation pour le promoteur de vous rembourser ce montant si le condo n\u2019est pas pr\u00eat \u00e0 la date fix\u00e9e dans le contrat pr\u00e9liminaire.<\/p>\n<p><strong>Taxes<\/strong><\/p>\n<p>Afin d\u2019\u00e9viter les mauvaises surprises, assurez-vous que le contrat pr\u00e9liminaire indique si le prix du condo sur plan inclut ou non les taxes \u00e0 payer, telles que la TPS et la TVQ.<\/p>\n<p><strong>3.\u00a0Les clauses optionnelles<\/strong><\/p>\n<p>Voici quelques exemples de clauses pouvant \u00eatre ajout\u00e9es, modifi\u00e9es ou retir\u00e9es du contrat pr\u00e9liminaire, d\u2019un commun accord avec le promoteur ou l\u2019entrepreneur.<\/p>\n<p><strong>Protection des acomptes<\/strong><\/p>\n<p>Depuis le 1er janvier 2020, les acomptes ne peuvent \u00eatre vers\u00e9s directement au promoteur \u00ab sans autre d\u00e9marche \u00bb, ce qui signifie qu\u2019ils sont prot\u00e9g\u00e9s par un plan de garantie, une assurance, un cautionnement ou un d\u00e9p\u00f4t dans un compte en fid\u00e9icommis. Bref, un promoteur ou un entrepreneur ne peut exiger que des sommes lui soient vers\u00e9es directement.<\/p>\n<p><strong>Protection contre les hypoth\u00e8ques l\u00e9gales<\/strong><\/p>\n<p>L\u2019hypoth\u00e8que l\u00e9gale permet \u00e0 toute personne qui a \u00e9t\u00e9 embauch\u00e9e pour la construction du condo de le prendre en garantie advenant le cas o\u00f9 le promoteur ou l\u2019entrepreneur ne la paierait pas pour son travail. Un d\u00e9lai de 30 jours maximal est accord\u00e9 pour publier une <a href=\"https:\/\/www.quebec.ca\/habitation-et-logement\/achat-vente\/recherche-propriete\/hypotheque-legale#:~:text=Une%20hypoth%C3%A8que%20l%C3%A9gale%20est%20une,de%20la%20volont%C3%A9%20des%20parties.\" target=\"_blank\" rel=\"noopener\">hypoth\u00e8que l\u00e9gale<\/a> sur votre future propri\u00e9t\u00e9.<\/p>\n<p>Afin d\u2019\u00eatre prot\u00e9g\u00e9 de cette \u00e9ventualit\u00e9, vous pouvez demander l\u2019ajout d\u2019une clause afin que le notaire conserve une partie de l\u2019argent devant \u00eatre remis au promoteur ou \u00e0 l\u2019entrepreneur jusqu\u2019\u00e0 30\u00a0jours apr\u00e8s la fin des travaux. Vous pouvez aussi exiger que le promoteur obtienne\u00a0une <a href=\"https:\/\/lautorite.qc.ca\/grand-public\/assurance\/assurance-habitation\/assurance-de-titres\" target=\"_blank\" rel=\"noopener\">assurance-titres<\/a>.<\/p>\n<p><strong>Choix du notaire<\/strong><\/p>\n<p>M\u00eame s\u2019il est fr\u00e9quent qu\u2019un promoteur veuille confier l&#8217;ensemble d&#8217;un projet au m\u00eame notaire, le choix final revient \u00e0 l\u2019acheteur. Si vous souhaitez d\u00e9signer le notaire qui s\u2019occupera de l\u2019acte notari\u00e9, vous devrez sp\u00e9cifier son nom dans le contrat pr\u00e9liminaire.<\/p>\n<p><strong>4.\u00a0La note d\u2019information<\/strong><\/p>\n<p>Le promoteur ou l\u2019entrepreneur a l\u2019obligation d\u2019accompagner le contrat pr\u00e9liminaire d\u2019une note d\u2019information incluant notamment :<\/p>\n<ul>\n<li>Le nom des architectes, des ing\u00e9nieurs, des promoteurs et des constructeurs<\/li>\n<li>Le plan de l\u2019ensemble du projet et un r\u00e9sum\u00e9 des travaux pr\u00e9vus<\/li>\n<li>Un budget pr\u00e9visionnel qui mentionne le d\u00e9tail des frais de condo<\/li>\n<li>La d\u00e9claration de copropri\u00e9t\u00e9 et du r\u00e8glement de l\u2019immeuble<\/li>\n<\/ul>\n<p>En tant qu\u2019acheteur, vous avez la possibilit\u00e9 de revenir sur votre d\u00e9cision tant que vous n\u2019avez pas re\u00e7u cette note. D\u2019ailleurs, le d\u00e9lai de dix jours applicable pour le droit de d\u00e9dit ne commence \u00e0 courir qu\u2019apr\u00e8s la remise de la note d\u2019information.<\/p>\n<p><strong>5.\u00a0Les mauvaises surprises \u00e0 \u00e9viter<\/strong><\/p>\n<p>Lors de la signature du contrat pr\u00e9liminaire, portez \u00e9galement une attention particuli\u00e8re \u00e0 la superficie promise, ainsi qu\u2019au d\u00e9lai de livraison qui peuvent varier en raison des nombreux impr\u00e9vus durant la construction.<\/p>\n<p><strong>Superficie habitable<\/strong><\/p>\n<p>Bien souvent, la superficie d\u2019un condo sur plan ne sera pas la m\u00eame que la superficie livr\u00e9e. Selon Me Ghislain Raymond, avocat au cabinet De Grandpr\u00e9 Joli-C\u0153ur : \u00ab Il n\u2019est pas rare de voir des diff\u00e9rences de superficie de 8 \u00e0 12 %, un bar\u00e8me acceptable selon le calcul des dimensions brutes et les modifications qu\u2019on a d\u00fb effectuer par obligation. \u00bb<\/p>\n<p>Cet \u00e9cart est d\u00fb au fait que la superficie des plans architecturaux est approximative, comparativement \u00e0 celle qui sera \u00e9tablie par l\u2019arpenteur-g\u00e9om\u00e8tre. De fait, la superficie indiqu\u00e9e sur les plans est g\u00e9n\u00e9ralement brute, c\u2019est-\u00e0-dire qu\u2019elle est calcul\u00e9e \u00e0 partir des murs ext\u00e9rieurs et non des cloisons int\u00e9rieures. R\u00e9sultat? Vous pourriez perdre de pr\u00e9cieux centim\u00e8tres.<\/p>\n<p><strong>D\u00e9lais de livraison<\/strong><\/p>\n<p>Le contrat pr\u00e9liminaire prot\u00e8ge souvent le promoteur ou l\u2019entrepreneur en lui enlevant toute responsabilit\u00e9 advenant un retard de livraison, si celui-ci r\u00e9sulte d\u2019une force majeure. Il est donc recommand\u00e9 de pr\u00eater attention \u00e0 cette clause afin d\u2019\u00e9viter de devoir payer des frais d\u2019entreposage et d\u2019h\u00e9bergement impr\u00e9vus.<\/p>\n<p>L\u2019achat d\u2019un condo sur plan peut s\u2019av\u00e9rer particuli\u00e8rement int\u00e9ressant si vous souhaitez avoir une propri\u00e9t\u00e9 neuve et enti\u00e8rement personnalis\u00e9e.
